Applicable Law

These general conditions of sale apply to all reservations made via the internet, through the website www.hotelmaisonmonceau.fr. They are governed by French law without prejudice to the mandatory protective provisions of the consumer’s country of residence. Prior to placing an order, the customer declares that the reservation is made for personal use and affirms having full legal capacity to engage under these general conditions. During the reservation process, the following information is presented at various stages: prices, payment methods, general sale conditions, and accepted payment methods.

Reservation:

The customer acknowledges having reviewed the reservation terms and conditions for the services available on the website www.hotelmaisonmonceau.fr and has requested and obtained the necessary and/or additional information to make their reservation in full knowledge of the facts. They remain solely responsible for their choices regarding the services and their suitability to their needs, and no liability of the hotel can be sought in this regard. The reservation is deemed accepted by the customer upon completion of the reservation process. Reservations made by the customer are processed through our electronic reservation system (provided by D-EDGE) accessible online via the website www.hotelmaisonmonceau.fr. Upon receipt of the reservation confirmation, or during online prepayment by credit card, the reservation is considered confirmed. The customer certifies that the information provided is truthful and accurate.

The Website confirms receipt of the customer’s reservation by promptly sending an email to the address provided by the customer. For online reservations, the reservation acknowledgment email summarizes the stay offer, reserved services, prices, sales conditions related to the selected rate, accepted by the customer, the date of reservation, information related to after-sales service, and the address of the establishment from which the customer can submit complaints.

Cancellation or modification of the reservation can be made directly on the Website or directly with the hotel.

In the event of a stay interruption caused by the customer, the full agreed price will be charged. In the case of reservation with prepayment, no refunds will be granted.

The customer is informed that they must vacate the room by 11:00 a.m. on the day of the reservation end date. Otherwise, an additional night will be charged. All reservations are nominative and personal. They cannot be transferred to a third party, whether free of charge, for a fee, or for commercial purposes.

Upon arrival, the customer may be asked to fill out a police form accompanied by an identity document to verify their identity.

In the event of an exceptional circumstance, inability to provide the reserved room, or force majeure, the hotel reserves the right to accommodate the customer fully or partially in an hotel of equivalent category, for similar services, subject to prior approval by the customer. Any additional cost of the room, transportation between the two hotels, and a phone call remain the responsibility of the selected hotel.

The hotel offers free Wi-Fi access allowing guests to connect to the internet. The customer agrees that the IT resources provided by the hotel are not to be used for reproduction, representation, making available, or public communication of works or objects protected by copyright or neighboring rights, such as texts, images, photographs, musical works, audiovisual works, software, and video games, without the authorization of the rights holders as required by books I and II of the Intellectual Property Code. Failure to comply with these obligations may constitute a copyright infringement (Article L.335-3 of the Intellectual Property Code), punishable by a fine of €300,000 and up to three years’ imprisonment.

Dispute Resolution:

The customer is informed that any dispute regarding the interpretation or execution of these legal notices will be subject to French law and the competent courts. The customer is also informed of the possibility to resort to a conventional mediation procedure or any other alternative dispute resolution method. In case of a dispute between a professional and a consumer, they will attempt to reach an amicable solution. Failing an agreement, the consumer can free of charge contact the consumer mediator of the professional’s jurisdiction, namely the European Mediators Association (AME CONSO), within one year from the written complaint sent to the professional. The mediator can be contacted by: – completing the form available on the AME CONSO website: www.mediationconso-ame.com; – or by mail sent to: AME CONSO, 197 Boulevard Saint-Germain, 75007 PARIS.

Pricing and Tariffs:

Prices are listed per room, per number of persons, and for the selected date. They are confirmed inclusive of taxes, in the hotel’s commercial currency, and valid for the period indicated on www.hotelmaisonmonceau.fr.

Unless otherwise stated, additional services (breakfast, half-board, full-board, etc.) are not included in the price. The tourist tax is payable directly at the hotel, except in the case of online prepayment, where it may be included. Prices include applicable VAT on the day of booking. Any modification or introduction of new legal or regulatory taxes by authorities will automatically be reflected in the prices at the time of invoicing. Upon reservation confirmation, the hotel will specify the total amount of the booking. The customer provides their credit card details as a guarantee, unless special conditions or rates apply.
